Legal Services and their Various Aspects

The term ‘legal service’ was originally used to refer to free service or assistance in the field of law. It is also interchangeably used as legal aid and is meant for those who cannot afford access and representation in a court system. Legal services in Canada are considered one of the most important pillars in the achievement of equality of reach to law and the demand for a fair trial. There are a number of methods for delivering legal aid or legal justice such as through community legal clinics and duty lawyers.

The models of delivering legal services and legal aid in the United States of America are looked after by The Legal Services Corporation. There is the staff attorney model where the government pays lawyers and employs them for the purpose of providing legal aid to clients belonging to low-income groups. This group of lawyers may be comparable in their working procedure to staff doctors in public hospitals. The judicare model is another model where private law firms and law practitioners are paid for taking up eligible clients as well as from clients who are able to pay their due fees. Doctors who handle Medicare patients in the United States work in similar contract. Another prevalent model of delivering legal aid is through the community legal clinic. This consists of non-profit clinics which serve a certain community of the population through a wide range of its legal services such as education, representation, etc. where service is rendered by both lawyers and non-lawyers.

Those defendants who are undergoing criminal prosecution but cannot afford to pay for an attorney are provided with both legal aid services as per their charges and also representations as public defenders. Some lawyers, especially of the personal injury kinds, take up cases on a contingency fee basis. This means that the lawyer won’t take any fee unless you get paid. These kinds of cases are best suited for those who have a high chance of winning their case. Here, the attorney starts the work by announcing a percentage of the claim that he or she wants once the settlement in successful. This percentage varies from one state to the other and from one case to another, but is usually around 30%-40%. However, this percentage does not include court fees and similar expenses.
