Important steps you should take after suffering a personal injury:

Motor Vehicle Accidents

When dealing with motor vehicle accidents in Ontario there are 2 types of claims.
The first is Torts, which are claims against the drivers and Accident Benefits claims
which are against the insurance companies. While there are conditions about how
and when to make a tort claim, they are designed to compensate you and your loved
ones for health care, pain and suffering and attendant care expenses.

Tort Claims
|
Tort is a lawsuit for damages against an individual(s) or defendant(s) who is at
fault and responsible for the accident or has committed an act of negligence or
a civil wrong against another party or parties. As the plaintiff, you must file
a statement of claim within 2 years from the date of the accident. The two primary
damages to claim are pain and suffering and loss of income.
What can you claim in torts?
- General Damages (Pain and Suffering)
- Loss of Income and ability to earn income
- Home Maintenance and Housekeeping
- Health care expenses other than OHIP

Animal/ Dog Bites
|
The behavior of animals cannot be predicted to a 100% certainty; Although, Ontario
laws require owners of animals to be in full control of their pets so as to protect
the public from animal attacks and ensure the safety of the public, experience has
shown that pet owners are not always in compliance with the law. The law states
that when a dog bites or attacks a person or another pet, the dog’s owner is liable
for any damages that may result from the accident. If the dog has more than one
owner, then both or all the owners are equally liable for the damages. The damages
awarded can depend on the degree of the attack and the contributory negligence of
the owner in failing to restrain the dog’s actions. For example, if the owner failed
to hold back their dog or ignored their dog’s aggressive behavior, then damages
will be in favor of the plaintiff based on the grounds of negligence of the owner.
If the victim in some ways provoked the dog to its aggressive state or voluntarily
solicited the dog for a play, then the damages may be reduced significantly because
the victim was negligent in terms of reasonable care.
If a third party was responsible for the dog’s actions like a dog walker or sitter
then the owner is still liable to pay the damages, but he can then require the third
person to pay for part of the damages

Brain/ Spinal Injuries

Generally there are two types of Traumatic Brain Injuries (TBI). Open and Closed.
Both types can cause complete paralysis and even death. An open Injury consists
of the skull being fractured and is usually caused by a significant blow to the
head. A closed injury does not have a fracture in the skull, however at times this
may be the more serious injury because there might be some swelling in the brain.

Spinal cord injuries along with neck injuries are very serious. This type of injury
can cause paraplegia or quadriplegia depending on the location and extent of the
impact. In a majority of cases these injuries become debilitating and irreversible.

Occupiers Liability

Occupiers liability claims arise from injuries suffered while on someone else’s

Medical Malpractice
|
Medical malpractice suits usually arise due to the professional negligence of a
medical practitioner (by act or omission). The medical practitioner (specialists,
doctors, nurses, pharmacists, dentists, medical technicians and alternative health
practitioners, including chiropractors) has made an error while treating the plaintiff,
which consequently resulted in injury or death. In these types of cases you must
show gross negligence on the part of the medical practitioner and that their care
has fallen below the minimum standard which the medical profession regards as acceptable.

Accident Benefits are benefits you can receive from an insurance company regardless of who is at fault. Following a car accident you should complete an “Application for accident benefits” form. The amount of compensation to which you are entitled to is dependent on your circumstances and is governed by SABS (Statutory accident benefits schedule).
